Mumbai, April 22: A designated MCOCA court here on Saturday allowed Aurangabad Arms Haul case accused Mohammed Muzaffar Mohammed Tanver to attend the wedding ceremony of his only sister in Aurangabad.
Judge S M Modak while granting the permission directed the accused to bear the to and fro charges of the six police constable who will escort him to Aurangabad from Mumbai prison where he is presently lodge.
The court while granting the permission from April 25 to April 28 directed him not to misuse the permission and not to indulge in any objectionable activities during this period and he will be kept in jail after the sunset in Aurangabad central jail. His sister is getting married on 25th April.
The permission was granted after defense made an application saying that “Application is more on humanitarian ground rather than claiming any legal rights and certain facts are required to be taken into consideration as accused’s father expired long back, mother is sick and he is the head of the family.”
The court also put the burden on accused to deposit the escort charges for 12 hours by considering six police staff which would be approximately Rs54,000. Earlier the jail staff had demanded escort charges of 24 hours of six cops which was Rs 1.8 lakh approximately.
Adv. Farhana Shah argued for the accused while Public prosecutor Raja Thackeray replied on behalf of the state.
Jamiat Ulama e Maharashtra is providing free legal aid to the accused in Aurangabad arms haul case.
Earlier his bail application was rejected on the same ground hence accused went for parole.
Allegations against Mohammed Muzaffar Mohammed Tanver in Aurangabad Arms Haul case: He is cousin brother of Accused number one Mohammed Amir. He was arrested on 10/05/2006 (on surrender). He is driver of the TATA Indica car which was allegedly containing 5 computer boxes of arms and explosives. But he says he had no knowledge about such consignment at all. He allegedly confessed on 31/05/2006 and 02/06/2006 while he retracted on 02/11/2006.
