Chennai; Prof. M. H. Jawahirullah, President of Manithaneya Makkal Katchi (MMK) on Wednesday described the judgment of the Special CBI Court in Babri Masjid demolition case as the final nail in the coffin of the Indian Judicial system. He said the CBI must appeal this Judgment and the guilty must be punished.
He said it was Justice Ranjan Gogoi who hit the initial nail in the coffin of the judicial system of the country and Judge S.K. Yadav has hit the final nail in the coffin by today’s verdict
He said the acquittal of the 32 accused including L.K.Advani, Murali Manohar Joshi, Uma Bharti, of the 49 persons against whom charge sheet was actually filed by the CBI, was on the expected lines and did not cause any surprise.
The judge observed that there was no adequate evidence of pre planning and conspiracy.
In a statement, Prof Jawahirullah said the court has failed to take into cognizance that the demolition of Babri Masjid to pave way for temple construction was a long term conspiracy of BJP then led by Advani and Joshi.
The resolution of BJP’s intellectual forum at Palanpur 1989 as well as several resolutions passed by BJP on various occasions was an ample proof for the same.
“It was Mr. Advani who himself led a Rath Yatra for organising Karseva at the Ayodhaya site in 1989, which led to serious violence and bloodshed in various parts of the country.”
He quoted Liberhan Commission observation which investigated into the destruction of the Babri Masjid.
“Advani, Joshi, Vijaya Raje Sindia directed karsevaks who got atop the structure to get down only for name sake. It was not known whether they did it with good intention or offered a lip service in the presence of the media men. No one prevented the karsevaks from entering the sanctum of the Masjid with the intention of demolishing it. The stoic silence of the leaders and their failure to prevent the karsevaks from entering the Masjid only proved that their real intention was that the structure should be demolished.”
“Thrash once again and the whole structure will come down”, Sadhvi Ritambara shouted and this was clearly broadcast in the media.
The Supreme Court even ordered one day imprisonment to Kalyan Singh in connection with the destruction.
A large number of people across the world who were witnessing the shocking development taking place in Ayodhya on December 6 1992, through the television channels were witness as to who were behind the conspiracy and were responsible for the destruction of the Masjid.
More than 100 U-matic video cassettes were produced in the court as witness to this act.
In spite of these evidences the Judge Yadav acquitted Advani and others dismissing the conspiracy theory.
He said at present the country accounted for two categories of judges. “One category do not fall a prey to the inducements of the people in power and even lay their lives for up keeping justice. Justice Loya belonged to this group. Judges like Ranjan Gogoi, former Chief Justice of India, belongs to the other category who wants to enjoy power even after retirement at the cost of justice. The judge Yadav by delivering such a judgment has only proved that he belongs to the second category.”
The Supreme Court in its verdict in the Babri Masjid title suit clearly stated that there was no evidence of any other structure at the site where Babri Masjid stood. Besides the Supreme Court also said the Muslims were offering prayers in the Masjid continuously for many decades.
The Supreme Court Bench condemned the destruction of Babri Masjid as “egregious violation of the rule of law”.
After mentioning all these things the Supreme Court awarded the Babri masjid site to those who were responsible for its destruction.
On the same line, the Lucknow CBI Special Court too has termed those involved in the destruction of the Masjid as anti-social elements. At the same time it ordered the acquittal of the leaders who invited them for the destruction of the five centuries-old historic mosque.
MMK leader also lambasted the CBI saying it cannot also be absolved of its complicity in the acquittal of the accused in the greatest terror crime committed in Independent India. CBI has become a pawn in the hands of the Union Government.
He said a time has come for all the forces which want to put an end to this injustice and prefer to see India as Gandhi ji dreamt to join together and launch struggles.
