New Delhi: Jamiat Ulama-i-Hind (JUH) has filed a plea in the Allahabad High Court seeking to quash a case registered against several persons including two women in connection with so-called ”love jihad” in Uttar Pradesh’s Sitapur.
The police have arrested 13 members of a Muslim family in the case, a report by Newslaundry said.
Jubraeel, 24, and Neetu Shukla, 19, allegedly eloped in the early hours of November 24 from Makhu Behad village, where they both live. Her father filed a complaint stating that she had eloped. On November 26, an FIR was filed under penal provisions related to kidnapping, abducting or inducing a woman to compel her into marriage.
Jubraeel and Neetu are untraceable. Police teams have been deployed to search for them. The teams went to Lucknow and Bahraich, and another to the Nepal border, but with no luck. Jubraeel’s phone has been switched off since November 24. His mobile signal was last tracked to Naipalapur, around 2.5 km from Makhu Behad.
Meanwhile, 13 members of Jubraeel’s family have been arrested. The police allege that they were involved in “planning” Neetu’s “kidnapping and forced conversion”. About 30 people have been interrogated so far.
In its petition, JUH opposed the police action and said that the government is harassing Muslims in the name of Love Jihad.
The petition is likely to be heard next Tuesday or Wednesday, said Gulzar Azmi, head of Jamiat Ulama Maharashtra Legal Aid Committee from Mumbai.
Giving the details of the case, he said that the families of the accused had sought legal help from President Jamiat Ulama-i-Hind Maulana Arshad Madani. After that, JUH approached the High Court to seek the release of the accused.
The petition filed through Advocate Arif Ali, Advocate Mujahid Ahmad and Advocate Furqan Khan, states that by taking undue advantage of its powers, government is harassing Muslims in the name of love jihad, and depriving them of their fundamental rights provided by the Constitution of India.
JUH chief Maulana Syed Arshad Madani said: “Such legislation is against the guiding principles of the Constitution of India, and it is an attack on the freedom and sovereignty of citizen.”
He said that at the time of making the law, it was claimed that it would be applied equally to all, and no group would be discriminated, but in an important state like Uttar Pradesh, this unconstitutional law is being used against a particular community. He further said that the affidavit filed by the Uttar Pradesh government in Allahabad High Court in a similar case is a mirror of this sad truth.
According to the affidavit, out of the 85 people who have been prosecuted under the law so far, 79 are Muslims, while others belong to the Christian community.
