New Delhi, July 26: The Delhi court on Thursday while pronouncing Azamgarh youth Shahzad Ahmed guilty in the Batla House encounter case clearly said the prosecution could not present any evidence before the court that could prove Shahzad is member of Indian Mujahideen.
Judge Rajender Kumar Shastri of Saket court agreed to the argument of Shahzad’s counsel Satish Tamta that prosecution has not proved that Shahzad or those killed in the encounter or arrested later were members of Indian Mujahideen.
“True, there is no evidence on record to establish that fact. At the same time, this court cannot be expected to endeavour in giving any finding about said fact…” wrote the Judge in his 47-page judgement.
Despite the clear observation of the court, mainstream media on Friday carried banner headlines presenting the accused as member of the banned shadowy terror group.
The first story on frontpage of Indian Express reads: “’IM member’ Shahzad found guilty in 2008 Batla House encounter”.
The Hindu writes: “Batla House: IM operative convicted”
