New Delhi: The Lucknow bench of the Allahabad High Court on Tuesday said that no coercive action should be taken against the committee members of the mosque that was demolished by authorities in Ram Sanehi area of Uttar Pradesh’s Barabanki district.
The local police had filed a FIR against President of the Committee, Mushtaq Ali; Vice-President Waqeel Ahmad; Secretary Mohamad Aneesh; and Dastageer, Afzaal Mohammad Naseem, along with Uttar Pradesh Sunni Central Waqf Board Inspector Mohammad Taha. They were accused of forging documents related to the mosque.
According to law related news website Bar Bench, Justices Attau Rahman Masoodi and Ajai Kumar Srivastava said that no coercive action should be taken against the petitioners and gave the state three weeks to file its counter affidavit.
“In the meantime, it is provided that until a police report under Section 173(2) Cr.P.C. is filed, the petitioners shall not be subjected to any coercive measures. It is made clear that the petitioners shall co-operate with the investigation and shall not evade their presence as and when called for,” the order said.
The judges found that the state government had provided no proof to the court of falsified or forged documents, but gave the government three more weeks to produce the evidence.
