Justice Gangopadhyay, who has been serving as a judge in the Calcutta High Court for several years, submitted his resignation to Chief Justice of India, expressing his desire to step down from the esteemed position. In a letter addressed to the Chief Justice, he emphasized personal reasons for his decision, without delving into specific details. The sudden announcement has triggered speculation and debate within legal circles and the political landscape.
Simultaneously with his resignation, Justice Gangopadhyay declared his intent to join the BJP, one of the leading political parties in India. This move has sparked discussions about the ethical implications of a sitting judge aligning with a political entity. The judiciary is expected to remain independent and impartial, and such affiliations can potentially raise concerns about the separation of powers.
“I have decided to join the BJP as it is a national party which is fighting against TMC’s corruption. Prime Minister Narendra Modi is a hardworking person and tirelessly working for the development of our country,” said Gangopadhyay.
Asked why he did not opt for the CPI(M) or the Congress as a political platform to join, Gangopadhyay said, “I believe in religion and God which the CPI(M) does not. Congress is a party which has been the zamindari of a family for years.”
Legal experts and scholars have weighed in on the matter, expressing varying opinions on the appropriateness of a judge engaging in active politics. Some argue that judges, by virtue of their positions, should refrain from overt political affiliations to maintain the public’s trust in the judiciary’s impartiality. Others contend that individuals, including judges, have the right to participate in political activities as long as they adhere to the legal and ethical boundaries.
The Calcutta High Court has not issued an official statement on Justice Gangopadhyay’s resignation and political move. The Chief Justice of India is expected to handle the matter judiciously, and the Supreme Court may also be called upon to address any legal implications arising from the judge’s decision.
