Delhi High Court rejects former PFI chairman E Abubacker’s plea seeking bail on medical grounds

The Delhi High Court “dismissed the request for medical bail made by E Abubacker, the former leader of the Popular Front of India (PFI) on Thursday.

The 70-year-old, in his petition, claimed to have a number of illnesses, including parkinson’s disease, a rare form of oesophageal cancer, high blood pressure, diabetes, and vision loss.

Abubacker was arrested by the The National Investigation Agency (NIA) and is behind bars since September 22.

After the NIA raised an initial objection regarding the petition’s maintainability, Justice Anoop Kumar Mendiratta rejected the petition as withdrawn.

“The NIA Act is a special act, we don’t have the power,”Mendiratta said.

“I can’t pass interim orders if I don’t have jurisdiction,” he said.

The NIA was represented by Special Public Prosecutor Akshai Malik, who argued that the bail request was unsustainable because the NIA Act requires the petitioner to file an appeal with the high court following the issuance of a trial court order, which is then heard by a division bench of the high court.

The accused’s counsel then made the decision to withdraw the plea.
