Deoband: Recently, a cleric from the country’s esteemed Islamic seminary, Darul Uloom Deoband, declared that test tube babies are not unlawful according to the Shariah law.
According to the news report published in Times of India, the cleric said “if both the sperm and egg belong to the husband and wife, they will be considered biological parents of the child. Even in case of surrogacy through artificial insemination, the child will still be considered the legal progeny of parents who underwent this procedure”.
On that Azeemullah Siddiqui, the spokesperson of Jamiat Ulema Hind, claim the IVF procedure as non-Islamic in nature.
The Clerics of Darul Uloom Deoband are well known for their controversial Fatwas on different aspects of lives, recently they had issued a fatwa that asked Muslim families to avoid marrying men or women working in the banking sector as they earned through interest which is “Haram” according to the Shariah.
Test tube baby – using husband’s own sperm and same wife’s own egg — would be permissible–if measures of specific medicines/treatments for sufficient period fail — in that case, it may be permissible, but makrooh ( disliked) rather than haraam (prohibited).
Using sperm from anyone other than husband or mixing it, or using egg/ovum from any other woman/other wife — is definitely haraam/ prohibited.
